Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and CAFE LOS HERMANOS LLC ("Cafe Loren Kitchen," "we," "us," or "our") governing your access to and use of the website at https://cafeloren54.com, our recipe membership, and our kitchen store (together, the "Service"). Please read them carefully.

1. Acceptance of These Terms

By accessing or using the Service, creating an account, or purchasing a membership or product, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you may not use the Service. You must be at least 16 years old, and able to form a binding contract, to use the Service.

2. Membership and Subscriptions

Access to premium recipes and member features requires a paid membership. We offer a monthly plan billed at $88.99 per month and an annual plan billed at $8.99, each in USD. Prices are shown at checkout and may change on renewal with prior notice.

Free trial. New members may be eligible for a 30-day free trial. If you do not cancel before the trial ends, your membership automatically converts to a paid plan and the applicable fee is charged to your payment method.

Auto-renewal. Memberships renew automatically at the end of each billing period (monthly or annual) at the then-current rate, until you cancel. By subscribing, you authorize us and our payment processor to charge your payment method on a recurring basis.

How to cancel. You may cancel at any time from your account settings or by emailing info@cafeloren54.com. Cancellation stops future renewals; your access continues until the end of the current paid period. Refund eligibility is described in our Refund Policy.

3. Kitchen Store Orders and Shipping

Product descriptions, pricing, and availability in our kitchen store may change without notice, and we may limit or cancel quantities. We offer free standard shipping on qualifying orders over $75.00; orders below that threshold are charged a flat shipping fee shown at checkout. Title and risk of loss pass to you upon delivery to the carrier. Returns and refunds for store orders are governed by our Refund Policy.

4. Acceptable Use

You agree not to misuse the Service. In particular, you may not: use the Service for any unlawful purpose; scrape, harvest, or systematically copy recipes or other content; share your account credentials or resell access to member content; attempt to gain unauthorized access to our systems or other users' accounts; interfere with or disrupt the Service; upload malicious code; or reproduce, distribute, or create derivative works from our content except as expressly permitted. We may suspend or terminate accounts that violate these Terms.

5. Intellectual Property

The Service and all of its content, including recipes, text, photographs, graphics, logos, and software, are owned by or licensed to CAFE LOS HERMANOS LLC and are protected by intellectual property laws. We grant you a limited, personal, non-transferable, revocable license to access and use the content for your own non-commercial cooking and household use. All rights not expressly granted are reserved.

6. Disclaimers

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that recipes will meet your expectations. Recipe and nutrition information is provided for general purposes only; please review our Disclaimer regarding food safety, allergies, and nutrition.

7. Limitation of Liability

To the fullest extent permitted by law, CAFE LOS HERMANOS LLC and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid to us in the twelve months preceding the event giving rise to the claim.

8. Indemnification

You agree to indemnify, defend, and hold harmless CAFE LOS HERMANOS LLC and its affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or connected with your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

9. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Subject to the arbitration provision below, you agree that the state and federal courts located in Florida, USA will have exclusive jurisdiction over any dispute not subject to arbitration.

10. Binding Arbitration and Class-Action Waiver

Please read this section carefully, as it affects your legal rights. Except where prohibited by law, any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by final and binding individual arbitration administered under applicable arbitration rules in Florida, USA, rather than in court. You and we each waive the right to a trial by jury. To the fullest extent permitted by law, you and we agree that claims may be brought only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. If any portion of this section is found unenforceable, the remainder will continue to apply.

11. Changes to These Terms

We may modify these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
